1、User Agreement

Confirmation and acceptance of terms and conditions under the Agreement

AION App and/or AION Website (Hereinafter referred to as “Platform”), ownership and
operation rights, belongs to AION AUTOMOBILE SALES (Thailand) Company Limited
(Hereinafter referred to as “We” or “us”). The User (hereinafter referred to as “You” or “User”) should carefully read and fully accept all the terms and conditions under this User Agreement (hereinafter referred to as “Agreement”) to use the functional services of this Platform. When the User opens and uses this Platform under any circumstances, it means that the User fully accepts all the terms and conditions stipulated in this Agreement. This Platform may add, delete, modify and / or supplement the terms of service of this agreement from time to time in accordance with the requirements of laws and regulations or the needs of business operators (hereinafter collectively referred to as "Modifications"). Unless otherwise specified, any modification will take effect immediately when the modified content is published. Your registration, use, and continued use of this Platform indicate that You accept such modifications. If You do not agree to any provisions of the terms of service of this User Agreement, you can terminate this Platform account or cancel the relevant services provided by this Platform.

2、Service Description
This Platform provides various services online. In order to enjoy the services provided by this Platform, you have to accept the following terms:
(1) This Platform reserves the right to change, interrupt or terminate some or all of the network services at any time. 
(2) While enjoying the various services of this Platform, User is deemed to agree and accept various information services provided by this Platform.

3、Use of the Platform
(1) After successful registration, the Platform will give you a User account. You can set a password for the account by yourself. The User account and password will be kept by the User. The User should properly keep the User account, password, and SMS verification code as well as avoid using a password that is too simple. User account numbers and passwords cannot be borrowed, transferred, inherited, or given away. We are not responsible if the User's account or password is lost, forgotten, or stolen by others due to reasons other than the responsibility of this Platform.
(2) The User's account name shall comply with the provisions of the “Internet User Account Name Management Regulations”, and no illegal or sensitive information shall appear in the registered information including the account name, profile picture and profile. This Platform has the right to review registration information such as account names, avatars and profiles submitted by Users. If the Platform found out that the registration information contains illegal or sensitive information, the Platform will reject such registration. For registered account names, avatars, and profiles that contain illegal or sensitive information, this Platform has the right to take measures such as modification within a notice period, suspension of use, and cancellation of registration, and the consequences are borne by the User.
(3) This Platform protects User information and citizens’ personal privacy, consciously accepts social supervision, and promptly handles illegal and sensitive information in registered information such as account names, profile pictures, and profiles reported by the public.
(4) To use the services of this Platform, Users must follow the following principles:
(a) Comply with laws and regulations, national interests, legal rights of citizens, public order, social morals and customs, and the authenticity of information, etc.;
(b) Do not use the network service system to transmit any harassing, slanderous, abusive, intimidating, vulgar, obscene or any other illegal information;
(f) Do not use this Platform’ s service system to perform any behavior that is detrimental to this Platform.
(g) Users shall not conduct financial transactions for registered accounts and published information in any form and for any purpose. Once discovered, the Platform has the right to delete all registered accounts related to the transaction and related information published.

4、Privacy Policy
The Platform will collect, use, store and share your personal information in strict accordance with this Agreement and Privacy Policy. Please check our Privacy Policy.
This Platform will not transfer or disclose your personal information to any third party without obtaining your prior consent, unless the Platform believes that this information is necessary in the following situations on the basis of good faith:
(1) Comply with relevant laws and regulations, or the requirements of the courts, public security organizations and other government agencies and departments.
(2) It is necessary to comply with the product service procedures of this Platform or provided services of this Platform.
(3) Make every effort to maintain the privacy of Users and the general public in emergency situations.
(4) To complete the merger, division, acquisition or asset transfer of this Platform.
(5) To maintain the interests of the Platform or other circumstances deemed necessary by the Platform.
The User hereby authorizes this Platform to send commercial/marketing information to the User’s e-mail address.
This Platform will use various security technologies and procedures to establish a complete management system to protect User’ s personal information, to prevent unauthorized access, use or disclosure of ownership transfer. Please refer to the [Privacy Policy Link] of this Platform for specific proprietary protection policies.

5、Minors’ Privacy
This Platform encourages parents or guardians to guide minors under the age of 20 to use the services of this Platform. This Platform also recommends the minors to encourage their parents or guardians to read this agreement, and to seek the guidance and consent of their parents or guardians before submitting to the registration for the use of the Platform services. Please check the Privacy Statement to find more information about how we protect minors’ privacy.

In the event that the minor under the age of 10 years old is the owner of the personal information registered to the Platform, such User shall obtain the prior consent from their parents or guardians to collect, use and disclose of the personal data.

6、Disclaimer
The content displayed on this Platform is provided on an “as - is" basis. We make no representations or warranties whether expressly or impliedly, directly or indirectly, including but not limited to:

(1) completeness, accuracy, reliability, appropriateness, and current content and information; as well as suitability for use.

(2) The service may be interrupted, and in some cases, the duration, safety and accuracy of the service are not guaranteed.

(3) This Platform has the exclusive right to display the purchased goods or services obtained by Users through any news, media, advertisements and presentations on this Platform.

We are not responsible for any loss or damage arising from the use of the Platform or the use of the content displayed on the Platform.

7、Information storage and restrictions
This Platform will provide appropriate security measures for preventing unauthorized or unlawful loss, access to, use, alteration, correction or disclosure of personal information. These duties shall extend to prevent the third party from using or disclosing such personal information unlawfully or without authorization.

This Platform reserves the right to determine whether the User’s behavior meets the requirements of the terms of service of this Platform. If the User violates the terms of service of this Platform, the Platform has the right to suspend or terminate part or whole of the User’s Platform services until the User’s registration on the Platform is cancelled.

8、Termination
The User or us can interrupt the service at any time according to the actual situation. We have the right to modify, interrupt and/or terminate whole or part of the service at any time without being responsible to any User or third party. If the User opposes the suggestions of any terms of service in this agreement or has objections to the subsequent modification of the terms, or is dissatisfied with the services of this Platform, the User can no longer use the services of this Platform. After ending the User service, the User's right to use the Platform's services is immediately terminated. From then on, this Platform or us no longer assumes any obligations to Users.

The User has the right to request for the personal information to be erased or forgotten upon the termination.

We reserve the right to consider not allowing Users to use this Platform, including reserves the right to make changes or suspend the application service, whether partially or fully and at any time without prior notice and/or clarify details or provide any reason.

9、Notice
Subject to the Privacy Statement, all notices sent to Users can be notified or published by means of short messages, emails, regular letters or webpage announcements. This Platform will send such notice to Users through email services or web announcements or in a manner deemed appropriate by this Platform to inform you of changes to the terms of service, service changes and/or other important matters.

10、Copyright and Trademark
The definition of content includes: text, software, pictures, graphics, charts, audio, video, web pages, domain names; all content in advertisements; all content of e-mails; and business information provided by the Platform service for Users, are protected by copyright, trademark, logo and other intellectual property rights. Users can only use these contents under the authorization of this Platform and/or related rights holders, and cannot copy or recreate these contents without authorization, or create derivative products related to the contents.

11、Applicable law and dispute resolution
The establishment, enforcement, interpretation and dispute resolution of this Agreement shall be governed by the local laws of Thailand (excluding conflict of laws).

12、Severability
If any of these Terms and Conditions were determined as illegal, invalid or otherwise unenforceable, it shall be severed and deleted. However, the remaining Terms and Conditions shall stand, remain in full force and effect, and continue to be binding and enforceable. No waiver by AION of breach of an obligation arising under these Terms and Conditions shall constitute a waiver of any other breach.

13、Link to other Platforms or websites
In some cases, this Platform may contain links to other Platforms or websites, provided that such links are for the benefit of Users and are not under control of the Platform or us. We are therefore not liable for any damage or loss. Any User who wishes to use the service of such other Platform or website, please carefully review the terms of service of the linked Platform or other website.

14、Breach of this User Agreement
In the event of a breach of this User Agreement, we reserve the right to suspend access or cancel any service provided on the Platform, while retaining the right to further legal remedies.
