AION AUTOMOBILE SALES (THAILAND) Co., Ltd and its subsidiaries (collectively "AION Thailand" or "we") honor your trust and privacy. This Privacy Policy informs you about our practices concerning your personal data's collection, use, disclosure, and protection when using AION app services (collectively the "Services") or when making a request to AION Thailand. Our policy also outlines your rights regarding your personal data, under the Personal Data Protection Act (PDPA) of Thailand.

In compliance with the PDPA, AION Thailand is the "data controller" of your personal data, implying we decide the purposes and means of its processing. This also denotes our responsibility for this processing, which extends to our subcontractors' processing of your information following our directives. This Privacy Policy pertains solely to products and services rendered by AION Thailand. Services offered by third parties are governed by their respective privacy policies, which will be explicitly delineated in this Privacy Policy.

We store the data collected from you in Singapore and process it in Thailand, irrespective of your domicile or data origin. Your personal data will be accessed and processed by AION Thailand affiliates, employees, contractors, and service providers globally, strictly as required for the purposes outlined in this Privacy Policy.

1. Information We Collect, Use and Process
1.1. we may collect and process information about you based on our relationship and the services or products you require from us. The personal data we may collect, use and process includes, but is not limited to, the following:

A) Personal Data Information
We may collect your personal data information about you such as profile picture, first name, last name, nickname, gender, date of birth, age, hobbies, first name prefix, last name, aliases, occupation, place of work, nationality, marital status, information on government-issued cards (e.g., ID cards, passports, driver's licenses, etc.), phone numbers, OTPs, signatures, audio recordings, recorded phone conversations or chats, messages, text messages, emoticons, photographs, and CCTV footage. This data helps us offer services tailored to your preferences and fulfill our obligations under the law.

B) Account and Contact Information
We may collect account and contact information from you, such as AION ID, account registration name or AION application username, profile picture, service or product usage history, photographs, telephone number, address, province, territory address, email address, AION account number, LINE, Google, Apple, Facebook, Instagram IDs and/or other social media IDs. If you provide us with personal data information about other people for contact purposes, you must ensure that you have their consent and we are legally allowed to use their personal information in accordance with this Policy.

C) Vehicle Information
We may collect information about your vehicle such as vehicle status, locked or unlocked status, horn, indicator lights, engine, windshield, air cleaner, sunroof, rear doors. seat heating and cooling systems, smart pre-cooling and remote operation history, vehicle location, vehicle identification number (VIN number), license plate number, make, model, sub-model, year, color, engine number, vehicle number, model year, mileage, battery status, oil level, aftermarket vehicle maintenance records, automobile insurance information, a breakdown of the information received when using automobile usage management systems and vehicle condition monitoring services (remote Information Processing System) and other automobile-related information. We use this data to provide you with comprehensive vehicle services. We use this information to process transactions and for billing purposes.

D) Transactional and Financial Information
We may collect information relating to transactional and financial information between you and us, including your financial information, such as payment details, date and/or time of payment, amount of payment, method of payment, details of refund requests, registrations, interest rates, down payments, instalments and number of instalments, date, and place of purchase of the product or service, address/date, and time of delivery of the vehicle and other details of the service you received or product you purchased. products you purchased, payment information, credit card details, debit card and bank account information, voucher information, order information and other financial information.

E) Marketing, Communications and Prospecting
We may collect information related to marketing, communications, and lead generation information, such as when you opt-in to receive marketing information from us or our AION partners, affiliates or business partners, including your preferred channel of communication, name, lead generation contact information, details of vehicles of interest, current vehicle, current vehicle color, test drive information and the source of the information. We use this data to send you personalized offers and promotions.

F) Technical Information
We may collect technical information such as Internet Protocol (IP) addresses, cookie data usage, device ID, device model and device type. Term of use and details of access to services. We use this information to ensure the proper functioning of our services and for security reasons.

1.2 When you use our products and/or services, we may collect, use, process, and/or disclose your personal data to third parties or to third parties outside Thailand. In accordance with the PDPA, we are committed to obtaining your explicit consent prior to collecting, using, processing or transferring any personal data and ensuring the use of said data aligns with the purpose it was originally gathered for. 

A) Account Registration 


For the creation of your account on the AION APP, we will require certain personal data such as your cell phone number and a verification code. Such data is necessary for account creation and management, as well as for you to access and utilize the full range of services and features provided by AION. Your explicit consent will be requested before any data collection or processing takes place, as per the requirements of the PDPA.

In updating your account, we provide a means for you to alter your registration information, like profile picture, nickname, gender, date of birth, occupation, and hobbies in the "My Profile" section of the App. We process this data to optimize your experience with our AION application. You can revoke the authorization for location, camera, and gallery in the "Settings" section of the AION application for a better experience.

B) Vehicle Status Management

This feature allows you to monitor your vehicle's status through the AION app. We may collect the following information about your vehicle with your consent:

Six door status (hood and rear doors)
Window status
Light status (low beam, high beam, left turn, right turn)
Total Mileage
Range (electric)
Fuel consumption
Quad Tire Pressure
Intelligent pre-cooling
Tire Temperature
Sunroof status
Air conditioning on/off
Seat air conditioner on/off
Air purifier on/off
Vehicle Position
View vehicle alarm information, vehicle fault information

Your consent to this Policy allows us to collect, process and use the information necessary to fully and efficiently use the AION APP, and in compliance with PDPA. 

C) Car Purchase
TEST DRIVE: When booking a test drive through the AION APP and AION Thailand website, you must enter your name, phone number, province, region of residence and/or information about your location (if you allow us to access) data) or any other personal data used for the purpose of the test drive. We will collect and process your information so that AION Automotive Business Partners (AION Partners) can confirm the test drive request information and display the distance from AION Partners to your location. This is necessary for AION Partners to confirm your request or order and facilitate the process.

PLACING ORDERS: When you place an order on the App, you will need to provide your name, address, phone number, region, state, email address (to receive booking confirmation documents) and payment information in order to complete the order. Our third-party provider "2C2P (Thailand) Limited" will help you process your order, deposit, and payment. Please check https://2c2p.com/privacy to learn more.

For you to use the store search or navigation features, we will embed the HERE API/SDK in our application and HERE (called "HERE Global BV") will collect your location information. Your explicit consent is needed when you use the mapping services provided by HERE, the AION App or the website, please see https://legal.here.com/en-gb/privacy to learn more about privacy policy of HERE.

D) Logging and Event Tracking
As part of using the Products and Services, in order to safeguard your account, understand product suitability, identify abnormal account status, and provide you with in-vehicle services that better suit your needs, we may ask you to provide consent or agree to us automatically collecting and storing your usage as web log information, including:

a) Device Information: We will receive and record information about the device you are using (including your device model and version) based on your specific operations during the installation and use of the software, your browser, operating system version, and other software, hardware, and device environment information) and device location information (including the GPS location of your license).
b) Service Log Information: When you use our products and services, we automatically collect details of your use of our products and services and save them as service logs, including browsing, clicking, searching, collecting, function execution and event time points.

In order to improve the stability and security of our products and services and to provide a better experience for all users, we will embed the Google Analytics SDK in our applications. Google Analytics will collect your IP address, device brand, device model, device operating system and version, and your country of residence in order to track your use of Google Analytics will collect your IP address, device brand, device model, device operating system and version, and your country of residence in order to track your actions with respect to our products and services (including your browsing and clicking behavior on our applications), and to analyze errors and exceptions. E) Vehicle settings
This function allows you to view information about your vehicle, such as vehicle identification number, update time, engine number and vehicle model. Your explicit consent is necessary for us to collect this information from your vehicle.

F) Remote Service
This feature allows you to control your vehicle remotely. In order to provide this service, we need to collect some of your car's conditions, including locking/unlocking, hooter, blinker, hooter blinker, windows, air filter, sunroof, rear doors, heated seats, ventilated seats, smart pre-alarms. Cooling and your distant history.

In addition to the information contained in the above features, certain necessary information must be collected from you and/or your vehicle or we would not be able to recognize your vehicle and provide you with connected services. The above information primarily refers to the VIN of your vehicle. We collect some of your car's conditions for this purpose with your explicit consent.

G) Alarm Management
This feature allows you to be notified when an alarm occurs, or when the service is turned on or off. In order to provide this service, you need to turn on the switch in your cell phone to receive the message, otherwise the feature will not work. Your explicit consent is needed for this service to work effectively.

H) After-sales Maintenance
You can book maintenance appointments for your vehicle through the AION APP, which requires you to provide your name, cell phone number, location information, and your vehicle information, in order to provide you with better maintenance appointments as well as maintenance record checking functions. The above information will be captured once when you submit a service appointment and will be used by us for the duration of your use of the service. We will retain your information until you delete your account, at which time we will stop using it and delete it. You may also deny us further access to your location information by turning off location access authorization in the System Settings section of your phone.

Service Maintenance Alerts. We may track your AION ID, VIN, phone number, mileage and service history and send periodic maintenance reminders. We may also use this information to evaluate the quality of the services we provide and the services provided by our business partners. Your explicit consent is necessary for us to provide this service effectively.

I) Charging Map
With the AION app, you can easily search for charging points and it also has a navigation function that allows you to get to where you need to be without any stress. In order to provide you with the service, we need to collect your location information with your explicit consent, and you can turn off the authorization at any time in the system settings. 


J) Sharing a vehicle, or driving a shared vehicle
Multiple accounts can be created on the AION app and a vehicle can be connected to multiple accounts. If you drive a vehicle connected to more than one account, the user of each account will be entitled to access:
a) The location of the vehicle;
b) services that display information about the status of the vehicle

Similarly, if you drive a vehicle connected with an AION APP, the user of that app will have the right to access that information and the services mentioned above. This is done with the explicit consent of all parties involved.

1.3 In some cases, we may receive information about your personal data from third parties, such as our AION partners, affiliates, service providers or business partners. If you have previously consented to the disclosure of information to such persons, we encourage you to read the privacy policies of such third parties to ensure that you are aware of the guidelines and practices for protecting the personal information of such third parties.

However, if you have any questions or do not wish to receive information, notices, sales, or service promotions from such third parties. Please contact said third party directly.

Before sharing your information with third parties, we will ensure that they adhere to the PDPA, and that they maintain adequate safeguards for data protection.

1.4 You acknowledge and understand that you are under no obligation to provide us with your personal data, and any data provided is done so willingly with full, explicit, and informed consent under the PDPA.

If you object to providing us with your personal data or refuse to accept our recommendations, you can do so by setting up a privacy protection in your system preferences.

You also understand that we are under no obligation to verify the origin of personal data provided to us about you and that such data will be deemed to have been provided by you unless you prove to us that the information was provided to us without your consent.

If you choose to connect an account on the AION app to a vehicle that is already connected to another account, your phone number/email account, and the fact that you requested this connection will be shared through the AION app with the user(s) to whom you previously connected to the vehicle. This user or users will be given a PIN to allow you to connect to the vehicle.
You may withdraw your consent for our use of your personal data at any time, in accordance with the rights granted under the PDPA. Please contact our Data Protection Officer for instructions on how to proceed.

2. Purposes of collection, use, processing and how we use your information
We will only use your personal data for the purposes for which we collected it as set out in this Privacy Policy. If we need to use your personal data for other purposes, we will clearly notify you and explain the legal basis that allows us to do so. Please note that we will only collect, use, or process your personal data for the purposes outlined above if we have received your explicit consent to do so, in line with the PDPA.

In addition, we may use your personal data for the following purposes:

A) registration and authentication to achieve proof of identity in order to register and access our various services.

B) Communicating with you about products and services received from us or from AION partners, our affiliates, our service providers, or our business partners in order to push various notifications such as maintenance appointments, after-sales service, insurance renewals, information updates as well as to answer your questions and process orders or grant you access to specific information to facilitate or assist you in using our products and services.

C) to provide you with various services, such as vehicle-related services, product warranty, after-sales services, services related to vehicle utilization management and vehicle status monitoring (Telematics system), related insurance, payment, rights, and benefits, including the provision of other services requested by you to us or to our AION partners, and the provision of appropriate products and services to you, etc. 

D) fulfillment of contractual obligations between you and us and/or processing of your requests e.g., signing up for a test drive, sale and purchase of a vehicle, delivery of a vehicle, product warranty, after-sales service, etc.

E) Marketing activities, such as processing data and using it for marketing analytics, analyzing data to determine a better understanding of customer satisfaction and needs, notifications, public relations, advertisements, marketing campaigns, privileges, invitations to events, and promotions of our products or services, etc., through the various channels of contact that you have provided to us, such as the AION app, websites, phone calls, e-mails, text messages, addresses or other contact information.

F) Manage technical security audits and protections to secure products, websites, and applications. Determine network and data security, including preventing unauthorized access to our computers and other electronic communication systems and protecting files associated with the installation and updating of malicious software (malware distribution) 

G) Comply with laws, rules, regulations, orders, requirements, and laws to perform duties such as identity verification in accordance with the requirements of the Anti-Money Laundering Office, etc., and to take photographs, make audio recordings, make dynamic recordings, and other actions involving the security of persons or property, in order to protect our interests and to prevent misconduct from occurring on our premises or within our computer systems.

By accepting this Policy, you hereby consent and allow us to collect, use and process your personal data in accordance with this Policy and applicable laws and regulations.

3. How we share or disclose your information
We will only share or disclose your personal data for the purposes for which we collected it as set out in this Privacy Policy. Generally, we will not share or disclose your information with other parties not set out in this Privacy Policy unless we reasonably believe that it is necessary to do so in order to be compatible with the original purpose, to have a legal basis for doing so or to obtain access to your information. When sharing your personal data with third parties, we will take reasonable steps to ensure that these third parties maintain adequate data protection standards, in compliance with the PDPA.

For the purposes of this Privacy Policy, we may share or disclose your personal information to the following people:

A) AION Affiliated companies. In some cases, it may be necessary for us to transfer your personal data to such affiliates or to allow our affiliates to access your personal information for the purposes described above.

B) AION Partners. We may share and receive your personal information from AION partners.

C) Our Service Providers. We may share your Personal Information with third-party service providers or vendors to provide services on our behalf or to assist in the provision of products and services and the delivery of products or services to you, such as telecommunication service providers, network providers, technology and software providers, logistics and transportation service providers, emergency response service providers, research providers, and analytics and surveys of marketplace service providers, including marketing, advertising media, design creation and distribution, storage and cloud service providers, insurance service providers, legal service providers, account providers, and our auditors.

In this regard, by accepting this Privacy Policy, you consent and allow us to share or disclose your personal data to the relevant persons for the purposes of this Privacy Policy and applicable laws and regulations. You can read the privacy policies of these third parties to learn more about how they collect, use, or disclose your personal information. 

If you have any concerns or questions regarding our data protection practices, please contact our Data Protection Officer at 33/4 The Ninth Tower, Building A, 34th Floor, Rama 9 Road, Huai Khwang, Bangkok 10310 . We will retain your personal data for as long as it is necessary for the purposes set out in this Privacy Policy. Upon your request, or when the data is no longer required, we will safely and permanently delete or anonymize your personal data in line with the PDPA's data minimization principle.

4. Legal basis for collection, use, processing, and disclosure of your information
The legal bases for the use of your information as set out in this Privacy Policy are set out below:
A) it is necessary to use your information in order to fulfill our obligations under a contract with you (for example, to comply with a user agreement you have accepted for our website, product, application; and/or a contract for the services we provide to you); or

B) it is necessary to use your information for our legitimate interests or the legitimate interests of others (for example, to provide security for our websites, products, and applications; to operate our business and services; to ensure a safe environment for our employees and visitors; to comply with legal requirements and to defend our legal rights; to prevent fraud and to know the customers to whom we provide our services).

C) If we use your information for a specific purpose, we require your informed and explicit consent as required by applicable law, for which we will record the date, time, method, and content of such consent.

5. Your rights and obligations
We respect your legal rights in relation to your personal data. We set out below your legal rights and the steps we take to protect them:

A) The right to obtain information about the processing of your personal data and to access the personal data we hold about you;

B) The right to have your personal data corrected if it is inaccurate or incomplete;

C) The right to request that we delete your personal data in certain circumstances. We will provide a receipt of acknowledgment to the individual upon completion of the deletion process. Please note that in some cases you may ask us to delete your personal data, but we are legally entitled to retain it to comply with legal obligations.;

D) The right to receive some personal data in a structured, commonly used, and machine-readable format and/or to request that we transfer this information to a third party where technically feasible, under certain circumstances. Please note that this right only applies to the personal data you have provided to us.

E) The right to withdraw your consent to our processing of your personal data. However, we may still have the right to process your personal data if we have other legitimate grounds (other than consent). For example, we may need to retain your personal data to comply with a legal obligation; furthermore, if you withdraw your consent, this does not affect the lawfulness of processing your personal data prior to withdrawing your consent. You can withdraw your consent at any time, without providing a reason, and without any negative consequences. Once consent is withdrawn, we will stop any further collection, use, or disclosure of your personal data, except when permitted by law. Please note that if you do so, it may affect our ability to provide you with certain products and services. In this regard, you agree that if we are unable to provide you with certain products and services specified in any agreement between you and AION Thailand as a result of your withdrawal of the personal data specified herein, AION Thailand shall not be deemed to be in breach of such agreement. You shall have no claim for any loss, compensation and/or damages in connection with such agreement.

F) Object to and request a restriction of our right to process your personal data in certain circumstances. In certain circumstances, you may object to or request that we restrict our processing of your personal data, but we are legally entitled to continue to process your personal data and/or refuse the request in order to comply with legal obligations;

G) If you believe that any of your rights have been infringed by us, you have the right to lodge a complaint through our contact channels or with a supervisory authority.

H)    You can withdraw your consent at any time, without providing a reason, and without any negative consequences. Once consent is withdrawn, we will stop any further collection, use, or disclosure of your personal data, except when permitted by law.

Responding to your request: For security purposes, you may be required to provide a written request or otherwise prove your identity. Before processing your request, we may ask you to verify your identity. We will comply with your request without undue delay and within one month. If your request is complex or we receive a large number of requests, we may extend our response time by another two months, but we will inform you of this extension within one month of receiving your request. You may contact us as set out in Article 13 "How to contact us".

We will not respond to your request if your request falls into one of the following categories:

(1) It is related to the fulfillment of the data controller's obligations under laws and regulations;

2) Directly related to national security and defense security;

3) Directly related to public safety, public health, and significant public interest;

4) directly related to criminal investigation, prosecution, trial, and judgment execution;

5) Where the data controller has sufficient evidence to determine that the subject of personal data has subjective malice or abuse of rights;

6) Responding to the request of the subject of personal data may cause serious damage to the legitimate rights and interests of the subject of personal data or other individuals or organizations.

In these cases, we will inform you why we are not taking action on your request and notify you of your right to lodge a complaint with a supervisory authority or seek a judicial remedy.

6. Marketing information
We may provide you with advertisements or other marketing materials related to the goods and services of AION through emails, SMS, websites, and applications. In order to provide a better user experience, we may recommend products, services and activities based on the information. We will only use your personal data after obtaining your prior express consent and taking explicit affirmative action or indicating no objection in accordance with local data protection laws, which may require separate express consent. If you prefer not to receive such marketing information, you have the right to opt out at any time. We will provide a simple and straightforward method to opt out in all our marketing communications.

7. How we protect your information
The personal data we collect will be stored and processed primarily in Singapore. We may also process your information in any other country in which AION companies, affiliates, subsidiaries, or service providers operate facilities. In accordance with PDPA regulations, we will take steps to ensure these countries have comparable data protection laws or have provided adequate safeguards. Storage locations are chosen for efficient operation, improved performance and to create redundancy in order to protect data in the event of an outage or other problem.

We take steps to ensure that data collected in accordance with this Privacy Policy is processed in accordance with the provisions of this Policy and the requirements of applicable laws in the regions where the data is located. We have implemented industry-standard organizational, physical, and technical security measures to protect the personal data you provide and to prevent any unauthorized access to, disclosure of, use of, modification of, damage to, or loss of the data, including the following.

A) We use algorithms or technical measures such as AES256 and RSA to ensure the encryption of our services and products, especially your sensitive information such as your location information, recorded audio, etc. We regularly review our information collection, storage, and processing (including physical security measures) to prevent unauthorized system access

B) We will only grant unauthorized access to your personal data to our employees and third party personnel on a need-to-know basis to help us process your personal data, and provide services to you. These employees and external persons (third parties not authorized by us) are subject to strict contractual obligations of confidentiality.

C) We take security measures such as encryption to transmit and store certain types of your personal data.

D) The security of your personal data is extremely important to us. We will continue to strive to protect your personal data and put in place safeguards to prevent unauthorized access, use or disclosure of your personal data. We have regular testing processes in place to evaluate and assess the effectiveness of technical and organizational measures to ensure the security of such processing

E) We will carefully select business partners and service providers and ensure that such business partners and service providers are contractually obliged to comply. appropriate data protection obligations and relevant privacy and confidentiality legislation

F) We will organize security and privacy training courses or tests to raise awareness among our employees of the importance of protecting personal data

G) The personal data record you create by registering for our services can only be accessed using the unique password associated with that record. To protect the integrity of the information contained in this record, you should not disclose or otherwise reveal your password to third parties. If you believe that your password or record has been compromised, please inform us immediately.

In case of any data breaches, we will notify the affected individuals and the relevant authorities in accordance with the PDPA regulations.

8. Retention of your personal data
The length of time we retain your personal data will vary and will be determined based on the following criteria:

A) Purposes for which we use the data: the purposes for which we need to retain the personal data to obtain information or any other legal purpose for as long as it is necessary to satisfy or meet the requirements of that purpose

B) Legal obligations: applicable laws or regulations may specify a minimum period for which we must retain your personal data. When your personal data expires, we will either (1) delete and permanently destroy your personal data or (2) render your personal data unrecognizable. We will ensure this is done in compliance with the PDPA's retention and destruction guidelines.
9. Transfer of your personal data outside Thailand
We operate globally and we do business all over the world. As a result, we collect and transfer personal data worldwide. This means that we may transfer your personal data to a location outside your country/region. In these cases, we commit to adhere to PDPA cross-border data transfer rules. We will ensure that such transfers of your personal data are carried out with your consent and that the destination country/region has adequate standards of personal data protection.

However, if the destination country does not have adequate standards of personal data protection, such transfers of personal data will be subject to the exceptions set out in the applicable laws, regulations, and this Privacy Policy, except where you have given your consent, and provided you have been informed of the inadequacy of the standards of personal data protection in the destination country.
10. Minors' Privacy
Our products and services are designed for adults. We do not knowingly collect any personal data about minors (under twenty years of age). If a parent or guardian has reason to believe that a minor has provided us with personal data without his or her prior consent, please contact us to ensure that the personal data is deleted and that the minor unsubscribes from any AION mobile application or software. We strictly follow PDPA guidelines regarding the collection and processing of minor's data.
11. Cookies and other tracking technologies
A technology called a cookie can be used to provide you with customized information. A cookie is a tiny element of data that a website can send to your browser, which may then be stored on your hard drive so that we can recognize you when you return. You can set your browser to notify you when you receive a cookie. By registering online with any of our business units, you unconditionally agree to receive such cookies. other similar technologies may be used only to help us with our products and services, to understand and customize your preferences, and for no unrelated purpose, to optimize the user experience. You can accept or decline cookies used on our site by modifying the settings in your browser - check the help menu to change your cookie preferences. If cookies are disabled, this may mean that you are unable to take full advantage of all the features on our site. We will seek your explicit consent before deploying cookies, as per PDPA regulations.
12. Updates to our privacy policy
Our privacy policy may be updated from time to time. We will not limit your rights under this Privacy Policy without your express consent. For any changes or amendments, we will also ask for your consent again in a more prominent manner (including but not limited to text messages, special alerts on browsing pages, emails, etc.) and the revised Privacy Policy will be effective from the date of publication.  In accordance with the PDPA, any substantial changes in the way we process personal data will be communicated to you, giving you the opportunity to review the changes before they become effective. Publications: If you accept the revised policy, you will be deemed to have accepted the changes or updates to this Privacy Policy. Unless otherwise stated, the latest effective Personal Data Protection Policy applies to all your personal data. We will also retain the old version and display it at the bottom of this policy for your reference.
13. How to contact us
We have a dedicated department responsible for data protection in accordance with local requirements. Should you have any concerns or complaints about our processing of your personal data, you have the right to lodge a complaint to the Office of Personal Data Protection Committee under the PDPA.
